Indonesia's Aceh Passes Law on Stoning

The government of Aceh had not planned to propose a judicial review.

VIVAnews - Although the government of Aceh has rejected the Qanun (law) Jinayat (crimes) and Qanun Jinayat Code which contains stoning punishment for married adulterers, Aceh House of Representatives (DPRA) still passed the law.

Seven out of eight factions in DPRA stated their approval on Qanun Jinayat and Qanun Jinayat Code legalization. The Democratic Party was the only one who rejected the stoning punishment clause even though they agreed on Qanun legalization.

Aceh Deputy Governor Muhammad Nazar said the position of Aceh government, who disproved the stoning punishment clause on Qanun Jinayat, was very puzzling. According to him, Aceh government should keep enforcing the regulations according to the law.

“We still disallow the inclusion of stoning punishment in Qanun. So, it will be conditionally legalized and we’ll perform further actions in the future,” Nazar said on Tuesday, September 15.

He also said the government of Aceh had not planned to propose a judicial review on the regulations to the Supreme Court. “Whatever law being legalized, it must be implemented. We’ll think about the next steps,” he said.

The legalization of Qanun Jinayat that puts the stoning punishment in also yields criticism from several civilians in Aceh. Member of Aceh Civilians Network Liza Dayani said Qanun Jinayah and Qanun Jinayah Code are really premature.

“The compilation of Qanun didn’t involve the people and gave an impression that it was forced by the Council,” Dayani said.

Qanun would seemingly touch lower-class criminals. Although it includes hand-cutting punishment for thieves and stoning for adulterers, there is not any regulation on robbery, corruption and murder.
